Terms of Complete Template Set Up Service

By purchasing a listing for website design by Pretty Boss Designs, you are agreeing to these terms of service. Please review these terms of website design service carefully.
No Refunds. Due to the creative nature of the design work, no refunds will be provided once the template set up listing has been purchased and your design questionnaire has been submitted.
Working Days & Hours. Project work will be done Monday to Thursday, excluding Canadian holidays. Office hours are from 9 AM to 2 PM. Please note, working days and hours are subject to change.
Project Timeline. The project may last up to 11 business days total (including 5 business days for initial design, 3 business days for your review, and 3 business days for revisions). If no revisions are requested within your 3-day review window, the project is considered approved and complete.
Project Start Date. The project begins on the first full business day after you have submitted your design form and have purchased the service listing.
Communication. All communication will be through Etsy messages. Phone and video calls are not available. You agree to respond within 3 business days with any revision requests.
Content Submission. Your design form with website content need to be submitted before the project can begin. Pretty Boss Designs does not provide content writing services.
Scope of Work. This template set up service covers what is described in the purchased listing. It does not include logo or brand design. Any additional requests outside of what is detailed in the purchased listing may incur extra charges and may be requested separately based on availability.
Revisions. One round of revisions is included and must be submitted within your 3-day review window. Revisions requested outside of this window or beyond the single included round will incur additional fees.
Approvals. You agree to provide thoughtful and thorough feedback. It is your responsibility to thoroughly examine all work produced during the project to ensure it is accurate and free of errors.
Pretty Boss Designs will make every effort to prevent errors and omissions in the website setup. However, you agree to relieve and hold Pretty Boss Designs harmless from all liability related to potential errors and omissions. Once your 3-day review window passes or the project is considered complete, any subsequent changes to the website will require a new service order and additional costs.
Transfer of Ownership. The website will be transferred to you once the project is complete. You will be responsible for website maintenance and updates thereafter. Pretty Boss Designs will not be responsible for any edits or changes to the website after ownership transfer. Any fixes or changes you request after the transfer will incur a fee.
Credit. Pretty Boss Designs retains the rights to use the design work in portfolios, websites and other media to showcase the work. Non-final work products remain the designer's property.
Additional Expenses. Your purchase does not cover any additional costs such as, but not limited to, your Squarespace subscription, custom font licensing, email marketing, scheduling tools, and domain fee.
File Storage Release. You will provide Pretty Boss Designs with access to your Google Drive folder containing your website assets for the duration of the project. Once the project is considered complete, you agree that this access will be removed by either party. Furthermore, you agree that Pretty Boss Designs is not responsible for any lost or damaged files and that you are responsible for maintaining and backing up your own files.
Artistic Style Release. You have reviewed Pretty Boss Designs' portfolio and understand the website design will reflect the designer's style. The designer will use their judgment and creativity, which may not always align with your suggestions.
Legal Pages. You agree that you have the sole duty and responsibility to ensure all website terms and conditions and privacy policy legal documents comply with state, provincial, and federal laws. Pretty Boss Designs shall be held harmless for any failure on your part to place the necessary legal pages on your website.
Non-Disclosure of Confidential Information. We both agree to keep all Confidential Information private and only use it to fulfill the obligations of the project. Additionally, no copies of Confidential Information will be made unless requested.
Confidential Information includes, but is not limited to, technical data, know-how, business and financial data, trade secrets, and any other information intended to be confidential or reasonably considered confidential. Information is not confidential if it is generally known in the industry, public, known before service, received independently, or developed without knowledge of confidential information.
Limitation of Liability. Pretty Boss Designs is not liable for any lost data or content, lost profits, business interruptions, or any indirect, incidental, special, consequential, exemplary, or punitive damages related to the materials or services provided, even if advised of the possibility of such damages.
Maximum Damages. In all circumstances, Pretty Boss Designs’ maximum liability to you for damages for any and all causes whatsoever, regardless of the form of action (contract, tort, or otherwise), is limited to a refund that does not exceed the total amount you paid.
Indemnification. You agree to indemnify and hold Pretty Boss Designs, its heirs, legal representatives, and employees harmless against any liability arising from the work produced, including but not limited to websites and other designs. Pretty Boss Designs is not liable for any hosting, development, maintenance, or other third-party services. Pretty Boss Designs is not responsible for the backup, storage, and services provided by the website platform and other third-party software.
Results Disclaimer. Pretty Boss Designs makes no guarantees regarding the results you may obtain by working together. Pretty Boss Designs does not guarantee profits, financial gains, or traffic. Results depend on several factors, including but not limited to: your cooperation, creative vision, and target audience.
AI Disclaimer. Unless you have explicitly requested that AI tools not be used on your project, Pretty Boss Designs may use AI tools to assist or enhance the work, but the final product remains a human creation. While AI does not replace human expertise or judgment, the accuracy or reliability of AI-generated content cannot be guaranteed. By using these services, you accept the inherent limitations of AI technology, and Pretty Boss Designs cannot be held liable for any related errors or omissions.
Accessibility. Pretty Boss Designs shall make reasonable efforts to ensure that the deliverables are designed and developed to be accessible in accordance with the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA. However, Pretty Boss Designs cannot guarantee full compliance with the WCAG 2.1, Level AA guidelines and acknowledges that accessibility standards may evolve over time. You understand that while Pretty Boss Designs will make every effort to provide an accessible solution, it is your responsibility to regularly monitor and maintain the website to ensure compliance with the latest accessibility guidelines. If you require a guarantee of full accessibility compliance, it is recommended that you engage third-party vendors to provide constant monitoring and maintenance services. Pretty Boss Designs shall not be held responsible for any legal implications regarding accessibility.
Severability. If any term or condition set out in this terms of service is held to be invalid, unenforceable or illegal for any reason, the remaining terms and conditions will continue in full force.
Governing Law. These terms of service are governed by the laws of the Province of Ontario and deemed to be entered into by you in the Province of Ontario.
