Website Design Service Terms

By using the website design service from Pretty Boss Designs, you acknowledge and agree to these Terms of Service. Please review these terms of website design service carefully.
No Refunds. Due to the creative nature of the design work, no refunds will be provided once the website design service has been engaged and your project questionnaire has been submitted.
Working Days & Hours. Project work will be done Monday to Thursday, excluding Canadian holidays. Office hours are from 9 AM to 2 PM. Please note, working days and hours are subject to change.
Project Timeline. The project is typically completed within up to 2 weeks from the time all required assets are submitted (including questionnaire, photos, and brand materials). Delays in submitting content or feedback may extend the timeline accordingly.
Project Start Date. The project begins on the first full business day after your deposit has been received, and your project questionnaire and required assets have been submitted.
Communication. All communication will be through email or your designated project submission platform. Phone and video calls are not available. You agree to respond within 2 business days with any revision requests or required feedback. Delays in communication may extend project timelines.
Content Submission. Your project questionnaire and website content must be submitted before the project can begin. This service includes done-for-you website copywriting based on your questionnaire responses. Pretty Boss Designs does not require you to provide written website copy unless you choose to.
Scope of Work. This website design service covers what is described in the service description. It includes a Squarespace template-based website setup and implementation, customized using your content, branding, and copy. This includes template setup inside Squarespace, customization using your content and questionnaire responses, done-for-you website copywriting, up to 6 pages built, and basic SEO setup including page titles, meta descriptions, and image alt text. This is not a fully custom website design service. All work is completed within a pre-designed template structure.
Revisions. One round of revisions is included. All revision requests must be submitted within your 2 business day review window and provided as a single consolidated list. Additional revisions or requests outside of scope will incur additional fees.
Approvals. You agree to review all work carefully during your 2 business day review window. If no revision request is submitted within this window, the project will be considered approved and complete. It is your responsibility to ensure all content is accurate and reviewed in full. Pretty Boss Designs will make every effort to prevent errors and omissions in the website setup. However, you understand that final approval is your responsibility. Once the project is approved or the review window has passed, Pretty Boss Designs is not liable for errors, omissions, or inaccuracies. Any changes requested after completion will require a new service order.
Transfer of Ownership. The website will be transferred to you once the project is complete and final payment has been received. You will be responsible for your website platform subscription, domain connection, website maintenance, and updates. Pretty Boss Designs will not be responsible for edits or changes after ownership transfer. Any post-transfer support or changes will incur a fee.
Credit. Pretty Boss Designs and any designers working under Pretty Boss Designs retain the right to use the design work in portfolios, websites, and other media to showcase work. Non-final work products remain the designer’s property.
Additional Expenses. Your engagement of the service does not include any additional costs such as, but not limited to, website platform subscription fees, custom font licensing, email marketing tools, scheduling tools, or domain fees.
File Storage Release. You will provide Pretty Boss Designs access to a shared cloud storage folder or file-sharing platform containing your website assets during the project. Once the project is complete, access may be removed by either party. Pretty Boss Designs is not responsible for lost, deleted, or damaged files, regardless of platform used. You are responsible for maintaining your own backups.
Artistic Style Release. You understand that the website design will reflect Pretty Boss Designs’ style and the chosen template structure. The designer will use professional judgment and creative direction, which may not always align with all suggestions or preferences.
SEO Disclaimer. Basic SEO setup is included as part of the website build, which may include page titles, meta descriptions, and image alt text. While best practices are applied, Pretty Boss Designs does not guarantee specific search engine rankings, visibility, traffic, or performance results. SEO outcomes depend on multiple external factors including competition, market changes, and ongoing website management after project completion. If advanced SEO strategy or ongoing optimization is required, it is recommended that you work with a dedicated SEO specialist or third-party service.
Legal Pages. You are solely responsible for ensuring all website legal pages comply with applicable laws including privacy policy, terms, disclaimers, and any required legal requirements. Pretty Boss Designs is not responsible for legal compliance on your website.
Non-Disclosure of Confidential Information. Both parties agree to keep confidential information private and use it only for project completion. Confidential information includes business data, financial information, brand materials, processes, and any non-public information shared during the project. Confidential information does not include information that is publicly available, already known prior to the project, independently developed, or lawfully obtained from a third party.
Limitation of Liability. Pretty Boss Designs is not liable for any lost profits, data loss, business interruption, or any indirect, incidental, or consequential damages related to the services provided.
Maximum Damages. In all circumstances, Pretty Boss Designs’ maximum liability is limited to the total amount paid for the service.
Indemnification. You agree to indemnify and hold Pretty Boss Designs harmless against any claims, damages, or liabilities arising from your website content, business operations, or third-party services. Pretty Boss Designs is not responsible for website platform functionality, domain providers, or third-party tools used in connection with your website.
Results Disclaimer. No guarantees are made regarding business results, income, inquiries, traffic, or website performance. Results depend on multiple external factors including your audience, market, and how the website is used after completion.
AI Disclaimer. Unless you indicate otherwise in your project questionnaire before the project begins, Pretty Boss Designs may use AI tools to assist or enhance parts of the work. AI is used as a supporting tool in the creative process, but all final content is reviewed, refined, and approved manually by Pretty Boss Designs. While AI can support efficiency, ideation, and drafting, it does not replace professional judgment. AI-generated outputs may contain inaccuracies, limitations, or inconsistencies, and no guarantees are made regarding the accuracy, reliability, or completeness of any AI-assisted content. By proceeding with this service and submitting your project questionnaire, you acknowledge and agree to the potential use of AI tools unless you explicitly opt out prior to project start.
Accessibility. Reasonable efforts will be made to follow Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards. However, full compliance cannot be guaranteed. You understand that accessibility standards may evolve over time, and ongoing maintenance of your website is your responsibility after project completion. Pretty Boss Designs is not responsible for accessibility compliance or any related legal implications. If full compliance is required, it is recommended that you work with a dedicated accessibility specialist or third-party service.
Severability. If any part of these terms is found invalid or unenforceable, the remaining terms will continue in full effect.
Governing Law. These terms are governed by the laws of the Province of Ontario, Canada.
